PhonMail Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of PhonMail, including the PhonMail mobile application and the communication features, services and content made available through it (“PhonMail” or the “Service”).

PhonMail is developed and operated by Boveja Pharmaceuticals Private Limited (“PhonMail”, “we”, “us” or “our”).

By creating or using a PhonMail account, accessing the Service or continuing to use the Service, you agree to these Terms and the policies that apply to your use of PhonMail, including our Privacy Policy and Community Guidelines.

If you do not agree to these Terms, you should not use PhonMail.

1. THE SERVICE

PhonMail is a communication service currently built around five core modules:

Trusted Network
Trusted Network enables recipient-directed sharing between trusted relationships.

Chat
Chat enables direct communication using supported forms of content including text, photos, videos, voice messages, documents, files, contacts and other supported message types.

QR Chat
QR Chat enables communication through a PhonMail QR identity and supports permitted messaging and media features.

Mail
Mail provides recipient-directed mail-style communication.

Official
Official enables users to follow and receive supported content and updates from official or public sources.

Features may differ depending on device, software version, location, account status or technical availability.

2. ELIGIBILITY

You must have legal capacity under applicable law to use PhonMail and agree to these Terms.

If you are below the age at which you may independently consent to use an online service under applicable law, you may use PhonMail only where such use is legally permitted and any required parent or legal guardian consent has been obtained.

Nothing in these Terms removes protections provided to children or minors under applicable law.

3. YOUR PHONMAIL ACCOUNT

A PhonMail account is associated with a mobile phone number.

You must:

You are responsible for activity performed through your account except to the extent applicable law provides otherwise.

We may take reasonable protective action if we believe an account has been compromised, fraudulently obtained or used in violation of these Terms.

4. TRUSTED NETWORK

Trusted Network is designed around communication with selected or authorized relationships rather than a global public personal-user feed.

Availability of information through Trusted Network depends on relationship, authorization, blocking, sharing and other service controls.

You must not attempt to bypass relationship or access controls or obtain another person’s Trusted Network content without authorization.

5. PRIVATE AND RECIPIENT-DIRECTED COMMUNICATION

Chat, QR Chat, Mail and other recipient-directed functionality are intended to deliver content to participants or recipients permitted by the applicable feature.

When you send content to another person, that person may be able to view, save, copy, photograph, screenshot, forward or otherwise reproduce that content where permitted by the feature or their device.

You should therefore send information only to people you intend to receive it.

PhonMail cannot control what a legitimate recipient independently does with information after receiving it.

6. OFFICIAL CONTENT

The Official module may contain content intended for broader distribution.

Depending on the feature, Official content may be visible to followers, users discovering that source or the public.

The presence of an Official account, source or channel does not automatically mean that PhonMail endorses every statement, product, service or opinion published by that source.

Organizations and people using Official are responsible for the accuracy, legality and rights associated with the content they publish.

7. YOUR CONTENT

“Your Content” includes messages, text, photographs, videos, audio, documents, files, profile information, Status content and other information you create, transmit, upload or publish using PhonMail.

You retain the ownership rights that you already have in Your Content.

You are responsible for Your Content and must have any rights, permissions and consents required to send, store or publish it.

8. LIMITED LICENCE REQUIRED TO OPERATE PHONMAIL

By providing Your Content to PhonMail, you grant us a non-exclusive, worldwide and royalty-free licence only to the extent reasonably necessary to operate, secure and provide the Service.

This may include the technical ability to:

This licence does not transfer ownership of Your Content to PhonMail.

Where content is deleted, related processing may continue only where reasonably necessary for service operation, security, legal compliance, technical systems or information independently retained by recipients, subject to applicable law.

9. CONTENT INVOLVING OTHER PEOPLE

Before uploading or sharing photographs, recordings, documents, contact information or other material relating to another person, you must have any permission required by applicable law.

You must not use PhonMail to unlawfully invade another person’s privacy, disclose confidential information, impersonate another person or publish intimate material without authorization.

10. ACCEPTABLE USE

You must use PhonMail lawfully and comply with the Community Guidelines.

You must not use PhonMail to create, upload, host, send, store, publish, modify, transmit or share content or conduct that:

11. SPAM, AUTOMATION AND PLATFORM ABUSE

You must not:

Automated access is permitted only where PhonMail has expressly authorized it.

12. BLOCKING AND REPORTING

PhonMail may provide blocking and reporting functionality in supported areas of the Service.

Blocking may restrict future communication but may not remove content previously delivered or independently retained by another user.

When you submit a report, PhonMail may process the report, relevant content and contextual information reasonably necessary to investigate it, enforce applicable policies, protect users or comply with law.

Deliberately false, abusive or fraudulent reporting may itself violate these Terms.

13. MODERATION AND ENFORCEMENT

PhonMail does not promise that all user content will be reviewed before another person sees it.

Where we become aware of content or conduct that violates these Terms, the Community Guidelines or applicable law, we may take appropriate action.

Depending on the circumstances, action may include:

Enforcement decisions may consider seriousness, context, repetition, risk to users, applicable law and previous violations.

14. URGENT SAFETY AND SECURITY ACTION

We may take action without advance notice where reasonably necessary to:

15. INTELLECTUAL PROPERTY COMPLAINTS

You must respect copyright, trademarks and other intellectual-property rights.

A rights holder who believes content available through PhonMail infringes their rights may submit a complaint through an available PhonMail support or grievance process.

A complaint should provide enough information to identify:

We may remove or restrict infringing material and may act against accounts responsible for repeated infringement.

16. PHONMAIL INTELLECTUAL PROPERTY

PhonMail’s software, branding, logos, icons, design, user-interface elements, documentation and proprietary materials are owned by or licensed to Boveja Pharmaceuticals Private Limited and are protected by applicable law.

Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive and non-transferable right to use PhonMail for its intended purpose.

Except where applicable law expressly permits it, you may not:

17. PRIVACY AND PERSONAL DATA

Our Privacy Policy explains how PhonMail handles personal information.

The Privacy Policy should be read together with these Terms.

Optional permissions and device access are also subject to applicable in-app disclosures and your device permission choices.

See the public PhonMail Privacy Policy.

18. CONTACT ACCESS

Where PhonMail provides contact-based discovery or matching, access to device contacts is optional and requires applicable permission.

PhonMail is designed so that raw address-book contacts, saved contact names and raw phone numbers are not uploaded for matching.

Protected identifiers are used where applicable for privacy-preserving matching, while local contact names remain on the user’s device.

Denying optional contact access should not prevent use of unrelated PhonMail functionality, except where a contact-dependent feature reasonably requires that permission.

19. SECURITY

PhonMail uses authentication, backend authorization, access controls and other security measures intended to protect the Service.

No online service can guarantee absolute security.

You are responsible for maintaining reasonable security of your device, SIM and account access.

PhonMail does not currently provide end-to-end encryption.

Statements about privacy or security do not mean that a legitimate recipient cannot copy, forward or independently disclose information that you intentionally send to them.

20. STORAGE, ATTACHMENTS AND TECHNICAL LIMITS

PhonMail may impose technical limits relating to:

You should maintain your own copy of important information where appropriate.

PhonMail should not be treated as permanent archival storage.

21. SERVICE PROVIDERS AND THIRD-PARTY INFRASTRUCTURE

PhonMail may rely on third-party infrastructure and service providers for functions such as authentication, cloud hosting, storage, notifications, content delivery and app distribution.

Your mobile operating system, network carrier, app store and other independent services may also impose their own terms.

To the extent permitted by applicable law, PhonMail is not responsible for independent third-party products or services.

22. THIRD-PARTY LINKS AND CONTENT

Users or Official sources may share links or information relating to external websites, products or services.

PhonMail does not automatically endorse or guarantee external content merely because it appears in a message or Official update.

You access third-party services at your own discretion and should review their own terms and privacy practices.

23. USER-TO-USER DEALINGS

PhonMail provides communication functionality.

If users independently arrange purchases, payments, meetings, employment, professional services or other transactions through communications on PhonMail, those arrangements are between the relevant parties unless PhonMail expressly states otherwise.

Users should independently verify people, organizations and offers before relying on them.

24. NO EMERGENCY SERVICE

PhonMail is not an emergency communications service.

Do not rely on PhonMail to contact police, ambulance, fire, disaster-response or other emergency services.

Use the appropriate official emergency channel available in your location.

25. PROFESSIONAL INFORMATION

Information communicated through PhonMail may relate to health, finance, law, employment, education or other important subjects.

Unless expressly provided as professional advice by an appropriately qualified provider, such content should not be treated as professional advice endorsed by PhonMail.

Users remain responsible for seeking appropriate professional assistance where needed.

26. SERVICE AVAILABILITY

We aim to provide a reliable Service, but PhonMail is subject to technical availability.

The Service may be interrupted because of maintenance, updates, network failures, service-provider outages, security incidents, device incompatibility or events beyond our reasonable control.

We do not guarantee uninterrupted, error-free or permanently available operation.

27. CHANGES TO FEATURES

PhonMail may evolve over time.

We may add, modify, limit, replace or discontinue features where reasonably necessary for security, reliability, legal compliance, product development or legitimate operational reasons.

Where applicable law requires advance notice of a material change affecting legal rights, we will provide such notice.

28. ACCOUNT DELETION

You may request permanent deletion of your PhonMail account through the account-deletion functionality available in Settings.

If you no longer have access to the app, you may also request deletion from the Delete Your PhonMail Account page.

Account deletion is intended to be permanent.

Deletion may not remove information independently retained by recipients, including screenshots, downloaded files or other copies they obtained before deletion.

Limited information may be retained where required by applicable law or reasonably necessary for legal compliance, security, fraud prevention or dispute resolution, subject to our Privacy Policy.

29. SUSPENSION AND TERMINATION

You may stop using PhonMail at any time.

We may suspend, restrict or terminate access where reasonably necessary because:

Where appropriate and legally required, notice or an opportunity for review may be provided.

30. EFFECT OF TERMINATION

When an account is terminated, the right to use PhonMail ends.

Provisions that by their nature should survive termination, including ownership, intellectual-property provisions, certain content rights, disclaimers, liability provisions, dispute provisions and legal obligations, may continue to apply.

31. GRIEVANCES AND COMPLAINTS

PhonMail will provide a mechanism for users and affected persons to submit complaints or grievances as required by applicable law.

Until verified grievance-officer contact details are formally approved for publication, users may use PhonMail Support for ordinary product assistance at .

32. LEGAL AND GOVERNMENT REQUESTS

We may preserve, disclose, restrict or remove information where required by:

Where legally permitted and appropriate, we may seek clarification, limitation or review of such requests.

33. POLICY NOTICES

PhonMail may periodically provide users with notices or reminders concerning these Terms, the Privacy Policy, Community Guidelines, safety rules or consequences of policy violations.

This may include notice that prohibited content may be removed and accounts may be suspended or terminated.

34. DISCLAIMERS

To the fullest extent permitted by applicable law, PhonMail is provided on an “as available” basis.

We do not guarantee that:

Nothing in these Terms excludes consumer protections, warranties or rights that applicable law does not permit us to exclude.

35. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Boveja Pharmaceuticals Private Limited and its directors, officers, employees and service providers will not be liable for indirect, incidental, special, exemplary or consequential losses arising from use of or inability to use PhonMail where such liability may lawfully be excluded.

This may include loss caused by:

Nothing in these Terms limits liability that applicable law does not permit us to limit.

36. USER RESPONSIBILITY

To the extent permitted by applicable law, you are responsible for losses or valid claims resulting directly from your unlawful use of PhonMail, infringement of another person’s rights or content you provided without required authorization.

This provision does not impose liability where applicable law does not permit it.

37. CHANGES TO THESE TERMS

We may update these Terms because of:

Where applicable, the Terms will display an effective date or last-updated date.

Where required by law, we will provide appropriate notice before material changes become effective.

If you do not agree with updated Terms, you may stop using PhonMail and delete your account.

38. GOVERNING LAW

Subject to mandatory rights available under applicable law, these Terms and your relationship with PhonMail are governed by the laws of India.

A dispute that cannot be resolved through available grievance or statutory processes may be brought before a court or authority having competent jurisdiction.

Nothing in these Terms removes any mandatory right to approach a consumer commission, court, regulator or other authority where applicable law provides that right.

39. NO WAIVER

If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.

40. SEVERABILITY

If a competent authority determines that part of these Terms is invalid or unenforceable, that provision will be limited or removed only to the extent required, and the remaining provisions will continue to apply.

41. ASSIGNMENT

Subject to applicable law, Boveja Pharmaceuticals Private Limited may assign these Terms as part of a merger, restructuring, acquisition, transfer of the Service or similar corporate transaction.
